Public Offer — CLASH RP Garry’s Mod terms of use

Definitions

Resource — a website that provides information, goods and tools for users within Garry's Mod game servers. The Resource includes access to game resources, updates, and the ability to interact with other players.
Website — https://clashgmod.ru/ and its subdomains.
User — an individual with the legal capacity required to enter into this Agreement, who is granted the right to use the Platform within the limits set forth by this Agreement.
Platform — a term referring both collectively and individually to: the Website, software, game service and each of the Games hosted on the Website and made available for use by Users, all of their functionality, as well as the components and elements of the Website, each software, game service and each of the Games hosted on the Website.
Game — a computer online game which is a software program comprising a set of data, instructions and the audiovisual content they generate, activated sequentially to allow the User to achieve a specific outcome envisaged by the Game scenario (data and instructions), either free of charge (activated data and instructions) or upon payment of a license fee (non-activated data and instructions). The Game also includes game servers, in-game chat, store, databases and other project resources related to the Game. To enter the Game, the User runs a set of data and instructions on their own device (the «client part of the Game», if provided by functionality), while other data and instructions (including non-activated ones) or all data and instructions other than the client part are hosted on servers operated by the project.
Game client — software required by the User to participate in the Game, which the User installs independently on their personal computer or another technical device necessary to use the Game.
Account — the User's account, which contains data about the User and grants the User access to the Platform, User information, settings, in-game items, statistics and similar information.
Store — a section of the Platform where the User may purchase Goods.
Goods — real-world items offered by the Resource for purchase by Users exclusively for personal needs unrelated to business activities, whose range and specifications are shown on the top-up page.
Subdomain — a domain that is part of a higher-level domain.
SteamID — the unique numeric identifier of a Steam account. It can be represented in several formats, but the 64-bit account identifier (17 digits) is most commonly used.

1. Subject of the agreement

1.1. This offer agreement (hereinafter the «Agreement») is the official offer from the CLASH RP resource (hereinafter the «Resource») to an individual with the legal capacity required to enter into this Agreement (hereinafter the «User») to enter into a service agreement granting access to the platform (hereinafter the «Platform») hosted at clashgmod.ru and its subdomains.
1.2. By accepting this Agreement and using the Platform, the User is deemed to have accepted the terms of this Agreement.
1.3. The Agreement is a public contract under Article 426 of the Civil Code of the Russian Federation, is equivalent to a «verbal agreement» and has full legal force.
1.4. This Agreement is concluded at the moment the User accepts its terms. Actual use of the Platform by the User, entering the Game through the Resource server or using the Platform in any other way means the User has accepted the terms of the Agreement and is equivalent to concluding this Agreement between the User and the Resource. The Resource is entitled to require the User to confirm acceptance of the terms by placing a corresponding mark/checkbox or by any other means consistent with applicable Russian law.
1.5. The Agreement is considered concluded from the moment the User enters the server, the Website, or uses the Goods.
1.6. Pursuant to Article 438 of the Civil Code of the Russian Federation, the User making a donation payment to the Resource constitutes full and unconditional acceptance of the terms of the public contract.
1.7. By using the Resource, the User expresses agreement with this License Agreement and undertakes to follow the Rules of using the Resource.
1.8. The terms of the Agreement apply to all Games and services for as long as they are present on the Platform and available for use.
1.9. Disputes and claims between the User and other participants of the Resource (including the Resource itself) are resolved by the Resource if the matter falls within its competence. If the dispute cannot be resolved internally, it shall be settled in the manner prescribed by the laws of the Russian Federation.
1.10. The Resource Store is solely an in-game system and is governed by the project rules.

2. Description of services

2.1. The Platform is a website that provides information, goods and tools for users within Garry's Mod game servers. The Platform includes access to game resources, updates, the ability to interact with other players, and other functionality provided by the Resource.
2.2. All funds received from the User in favor of the Resource are voluntary donations.
2.3. Donating funds and purchasing goods in the store are solely a voluntary act of the customer.
2.4. The Resource bears no responsibility for issues with fund transfers related to other websites, payment systems, or issues arising on the part of and/or due to the fault of the user or third parties.

3. Procedure for providing services

3.1. Access to the Platform is provided to the User after creating an account on clashgmod.ru and its subdomains.
3.2. The User undertakes to use the Platform in accordance with the terms of this Agreement and the rules and provisions published on the Resource website.
3.3. In case the User violates the applicable rules, the Resource reserves the right to revoke the User's privileges.

4. Obligations of the parties

4.1. The Resource undertakes to provide access to the Platform in accordance with the terms of this Agreement.
4.2. The User undertakes to use the Platform in compliance with the rules and provisions established by the Resource and not to infringe intellectual property rights, third-party rights or applicable law.

5. Payment

5.1. Use of the Platform is free of charge, except for purchases of goods in the Store described on the Platform.
5.2. All privileges available on the Resource are a reward for gratuitous assistance to the Resource.

6. Liability of the parties

6.1. The Resource is not liable for unintentional Platform failures caused by force majeure circumstances.
6.2. The User is responsible for the confidentiality of their account and personal information and for using the Platform in accordance with the terms of this Agreement.
6.3. The User may use the Platform and its functionality, as well as access the Game, only through their Steam account (operated by Valve Corporation and/or its affiliates). The Resource does not administer such a User account and does not store the personal data provided by Users upon registration on Steam.
6.4. Access to the User's Account is granted by entering the login and password of the Steam account. The «login-password» pair acts as a simple electronic signature key and allows actions performed by the User to be considered as performed by them personally.
6.5. Ignorance of the offer agreement or the project rules does not release the User from liability or penalties.
6.6. In case the game servers change IP address, all goods purchased by the User are transferred from the previous server to the new one in full, possibly with compensation for damages.
6.7. Before purchasing goods, the User is required to review their features in the store. If such information is not available, the User must contact the project owner to find out what the goods represent and what features they provide.
6.8. If the User loses their account, receives a VAC ban, or transfers the account to third parties, the Resource bears no responsibility for the services and does not refund goods or donated funds.
6.9. The Resource has the full right to revoke the User's purchased privilege if the User behaves disrespectfully towards the Resource, fails to comply with the Resource rules and ignores warnings.
6.10. The User undertakes to comply with this offer agreement when donating funds to top up the personal account balance.
6.11. The Resource guarantees the confidentiality of the User's personal data in accordance with the law.
6.12. At their discretion, the User may stop the storage and processing of all their personal data by submitting a written request for profile deletion.
6.13. If the User has been inactive for more than 1 calendar year, or upon receiving any type of ban on the Resource and/or the Steam platform, the Resource reserves the right to irretrievably delete all User data (personal statistics, active services, personal account, etc.).

7. Miscellaneous

7.1. This Agreement enters into force upon acceptance by the User and remains in effect until terminated in accordance with the terms of this Agreement.
7.2. All disputes and disagreements arising between the parties during the performance of this Agreement shall be resolved through negotiations.
7.3. All privileges are linked to the User's unique identifier (SteamID in any form) and are not subject to: further transfer from one account to another, exchange between players, change, refund, or transfer to another server.
7.4. In case the Resource/game server is shut down or transferred to another owner, all available services are cancelled.
7.5. By registering on this Resource, the User formally consents to the Resource storing and processing their personal data, both provided during registration and posted during further use of the Resource.
7.6. This Agreement is not final. The Resource has the right to amend the text of this Agreement at its own discretion at any time and without prior notice to the User. The current (effective) version of the Agreement is always available on the Website.
7.7. The User agrees and acknowledges that any amendment to the Offer entails a corresponding amendment to the Agreement already concluded between the Resource and the User, and such amendments to the Agreement take effect together with the amendments to the Offer.

8. Privacy policy

8.1. The Resource processes the minimum data required for the Platform to operate: SteamID, Steam account data (via authorization), payment details and support requests.
8.2. Data is used to provide access to services, process donations, provide technical support, prevent abuse and improve the Platform.
8.3. The Resource does not share personal data with third parties except as required by law or with payment and technical partners necessary to provide the services.
8.4. The User may request profile deletion and cessation of data processing by contacting support@clashgmod.ru.
8.5. The Resource takes reasonable measures to protect data but cannot guarantee absolute security of information transmitted over the internet.
